Terms of Service

Review draft 0.9Not yet approved or effectiveProposed governing law: England and Wales
Review draft — not yet approved or effective. A business correspondence address, final legal review and effective date remain outstanding. This document does not create an effective contract.

1. Who we are and how to contact us

Zaviku is the trading name of Ahmed Alsaigh, an independent sole trader. Zaviku is not an incorporated limited company.

  • Operator: Ahmed Alsaigh, trading as Zaviku
  • Website: https://zaviku.co.uk
  • Relay application: https://relay.zaviku.co.uk
  • Contact email: [email protected]
  • Business correspondence address: not yet published; to be confirmed before final approval.

We do not publish a home address or personal phone number. In these Terms, “Zaviku”, “we”, “us” and “our” refer to Ahmed Alsaigh trading as Zaviku. “You” refers to a website visitor, prospective customer or, where applicable, an authorised user of Relay. “Business” means the organisation or sole trader on whose behalf a Relay account is held.

2. What these Terms cover

These Terms explain the conditions for visiting the Zaviku website and, only when Relay access is offered and separately agreed, using Relay. The public website provides information about Zaviku and its products. Relay is a field-service management application intended primarily for small service businesses.

Simply browsing the website or asking about early access does not create a paid subscription, give you an active Relay account, or mean you have accepted a future business-service contract.

When an account becomes available, the applicable Relay account Terms and any required Data Processing Agreement must be presented and accepted through an appropriate process before processing a business's customer data. The Privacy Policy and Cookies Policy are separate notices, not blanket consent to processing.

If a specifically agreed written contract conflicts with these general Terms, the specifically agreed contract takes priority for its subject matter. Mandatory legal rights always take priority over conflicting provisions.

Public website and separate Relay documents. These Terms govern the public Zaviku website and enquiries. Relay account services are not governed by this page alone. Before any Relay account is enabled, separate Relay account terms and a separate written Data Processing Agreement must be presented and accepted. Those documents are not published or effective on this marketing website, and nothing on this page makes the Relay DPA effective.

3. Current product availability

Zaviku's website describes products, services and proposed features. Relay is being prepared for invite-only early access. Public self-service registration and ordinary public sign-in are not open, online card payments and live paid subscriptions are not available, and the website does not offer a live checkout.

Any displayed Solo, Pro or Business pricing is proposed unless and until an actual plan is made available under clearly presented commercial terms. Expressing interest does not reserve a paid plan or create a payment obligation.

We will distinguish features available now from features planned or in testing and will correct material inaccuracies when identified.

4. Using the public website

You may browse Zaviku's publicly available pages and contact us for lawful purposes. Please do not interfere with the website, attempt unauthorised access, use automated requests that disrupt the service, upload malicious code, misrepresent your identity or misuse contact channels.

Website text, design, logos and software-related material belong to Zaviku or their respective rights holders. You may view pages for personal or internal business evaluation. You must not reproduce, sell or pass off substantial parts of the website or our branding without permission, except where law permits.

Links to third-party websites are provided for convenience; each external site is operated under its own terms and privacy arrangements.

5. Enquiries and early-access invitations

If you contact Zaviku, we may respond about the product, its availability and your enquiry. Sending an enquiry does not guarantee an invitation or access to Relay.

Where early-access places are offered, we may consider product fit, operational capacity, testing needs and security readiness. We will explain any specific beta conditions before granting an account.

Do not send sensitive customer records, payment-card details, passwords or confidential business documents through a general contact enquiry unless Zaviku has expressly established an appropriate secure process.

6. Eligibility and authority for Relay accounts

Once Relay accounts are enabled, each person entering an agreement on behalf of a Business must have the legal capacity and authority to bind that Business. Account holders must give accurate business and contact details and keep them reasonably up to date.

Relay is designed for professional and business use. If a person is legally acting as a consumer, applicable consumer-protection rights are not removed by these Terms. Additional consumer information and cancellation arrangements must be supplied before any consumer contract is concluded, where required by law.

7. Accounts, sign-in and team access

When access is available, Relay users must keep login credentials confidential, use individual accounts where required, and notify Zaviku promptly if they suspect unauthorised access. Do not share passwords or try to access another Business's information.

A Business owner is responsible for authorising staff access, selecting appropriate team roles, removing access when staff leave, and checking records entered by its team. Relay may apply plan-based seat limits and owner/member permissions. The account owner should review any permissions shown in the app before inviting team members.

We will use reasonable security measures and access restrictions appropriate to the service. You should also protect your devices, email accounts and account credentials.

8. What Relay does and does not do

When made available, Relay is designed to organise customers, quotes, jobs, schedules, invoices and manual payment records. It may support PDFs and secure customer-facing links for viewing relevant documents and responding to quotes.

Relay is not currently an online payment processor. Recording that a payment was received does not cause funds to transfer, verify receipt of money, or establish that a debt has been paid. Online card payments, Stripe Connect and live paid subscription charging are not currently available.

Relay does not replace professional accounting, legal, tax, regulatory or trade advice. Businesses remain responsible for checking their quotations, VAT treatment, invoice totals, payment status, legal obligations and the accuracy of information they share with their customers.

9. Quotes, invoices and customer links

A Business is responsible for the accuracy and legality of the documents and messages it creates or shares through Relay. A customer accepting a quote through a link does not make Zaviku a party to the contract between the Business and that customer.

Customer links should be shared only with intended recipients. A Business must take care not to forward private links publicly and should revoke links when appropriate. Features that allow links to expire or be revoked reduce risk but cannot guarantee that information already seen or downloaded by a recipient will be retrieved.

Zaviku does not guarantee that a quote, invoice or communication created using Relay meets every legal or industry requirement applicable to a particular Business.

10. Business information and data protection

As between Zaviku and a Business, the Business retains ownership of its customer, job, quote, invoice and other business records, subject to any rights it grants Zaviku to provide the service. The Business warrants that it has the necessary authority and lawful basis to enter and share information through Relay.

For typical customer records entered into Relay, the Business generally determines the purposes of processing and acts as controller; Zaviku generally processes those records to provide Relay as processor. Zaviku separately acts as controller for its own website, enquiries, account administration, security and other directly controlled processing.

Where UK GDPR Article 28 requires a binding controller–processor agreement, a separate written Data Processing Agreement must be in place before Zaviku processes personal data on the Business's behalf. Publishing a draft or linking to one does not mean it has been accepted or is effective. The Privacy Policy explains Zaviku's own processing; the Cookies Policy explains website storage and preference controls.

Neither the existence of a DPA nor use of Relay authorises Zaviku to reuse identifiable customer records for independent marketing or product profiling. Any product-improvement analytics must have a valid lawful basis and follow applicable cookie and analytics controls.

11. Service availability, changes and beta limitations

We aim to operate Relay with reasonable care and skill. Software services nevertheless require maintenance and can experience defects, outages or interruptions. We do not currently offer a contractual uptime service-level agreement.

During invite-only testing, features may change, be restricted or be withdrawn. Where practicable, we will give reasonable notice of material changes or planned shutdowns that affect active users. We will not intentionally present experimental features as guaranteed or permanently available.

You should keep independent copies of records that are important to your business. Backups and recovery procedures are intended to support service recovery; they are not a guarantee against every type of data loss. Before any real customer data is accepted, the service must satisfy its operational and contractual release requirements.

12. Security incidents and misuse

Please report suspected unauthorised access, data exposure or serious security problems promptly to [email protected]. Include enough information for us to investigate, but do not send passwords or unnecessary customer personal data in an ordinary email.

We may restrict or suspend access when reasonably necessary to protect the service, other users, or personal information, investigate credible misuse, comply with law, or address a material breach of an applicable agreement. Where appropriate, we will explain the reason and available next steps.

13. Charges, plans and billing

No payment is due merely for browsing the website, sending an enquiry or registering interest. The currently displayed Relay plan prices are proposals, not an offer of a live paid subscription.

If paid plans are introduced, the available plan, full price, applicable taxes, billing frequency, renewal arrangements, cancellation method and any other important conditions will be presented before the Business agrees to pay. We will not start recurring charges without the required agreement and a functioning payment arrangement.

Any future paid-service terms and any legally applicable cancellation or refund rights will be explained at the point of purchase. No payment-card processing is currently provided through Relay.

14. Export, closure and retention

Where accounts are available, an authorised Business owner may request the available export and closure functions. Some information may need to be retained for tax, accounting, fraud prevention, legal claims or other lawful purposes. Where possible and lawful, personal data is deleted or anonymised in accordance with the Privacy Policy and an applicable Data Processing Agreement.

Information removed from a live service may remain temporarily in secure rolling backups until those backups expire. The current local-backup design uses a rolling window of up to 14 days; that description must be updated if the backup system changes.

Business owners should export records they wish to retain before closing an account, where the export function is available. Zaviku will explain any limitations or reasonable timeframes applicable to a specific closure request.

15. Intellectual property and feedback

Zaviku and its licensors retain rights in the application, website, source code, branding, documentation and improvements. Where Relay access is granted, the Business receives a limited, non-exclusive, non-transferable right to use the service for its permitted internal business operations for the duration of its access.

The Business retains rights in its own records and materials. It grants Zaviku only the limited rights reasonably necessary to host, display, transmit, back up and otherwise process those records in order to provide the agreed service and fulfil lawful obligations.

We welcome feedback and suggestions. We may use general ideas to improve the product, but this does not permit us to publish confidential information or repurpose personal data contrary to applicable law, the Privacy Policy or a DPA.

16. Responsibility and liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or rights that applicable consumer law does not permit us to exclude.

Each party remains responsible for loss that the law makes it responsible for. Zaviku does not accept responsibility for losses caused solely by incorrect information supplied by a Business, misuse of the service contrary to clear instructions, or events genuinely outside Zaviku's reasonable control. Any restriction on liability is subject to applicable law and the circumstances of the claim.

No £100 cap or fees-based financial cap is included in this draft. Any proposed monetary cap, exclusion of lost profits or allocation of data-loss risk must receive separate legal review and be expressly agreed before it is used in binding Relay commercial terms.

17. Complaints and resolving disputes

For a complaint or question about these Terms, email [email protected] with a description of the concern. We will review it and seek to respond within a reasonable time. Privacy complaints and data-rights requests are handled under the Privacy Policy and applicable data-protection law.

We encourage both parties to try to resolve a dispute informally before starting court proceedings, without restricting anyone's right to bring a claim or seek urgent relief.

18. Governing law and rights

Subject to any mandatory consumer protections and other overriding laws, these Terms are proposed to be governed by the law of England and Wales. Where legally permitted, disputes about business use of Relay are subject to the courts of England and Wales. Consumers retain any mandatory rights concerning jurisdiction and applicable law. The governing law remains subject to final confirmation.

If a provision of these Terms is unenforceable, the remaining provisions continue to apply so far as legally possible.

19. Changes to these Terms

We may amend these Terms to reflect changes in the service, security, law or business operations. The current published version and effective date will appear on this page. Material changes affecting account holders will be notified through a suitable channel, and renewed agreement will be requested where required.

We will not treat a visitor's silence, cookie preference or mere continued browsing as acceptance of a new paid subscription or a new Data Processing Agreement. Earlier versions and records of required account acceptance should be retained in accordance with an appropriate recordkeeping process.
